By-Laws

1. Fifty-one percent of the seats filled by the Board of Directors shall constitute a quorum for the transaction of business.

2. Exhibitors, upon purchase of a membership ticket, shall be entitled to compete for premiums, but must conform to and be governed by the rules of the Mercer County Agricultural Society and State Department of Agriculture of Ohio.

3. All articles entered for premiums must be in the name of the bona fide owner. Stall rent shall be as follows: (see various departments for stall and pen rent. ) Payments to be made at the time of entry. Horse stalls will be allotted first come, first served.

4. Any member of the Board who shall, by virtue of his official position, use any means to defeat an impartial award shall, on conviction thereof, forfeit his membership, and the Board shall appoint his successor.

5. Any person who, by letter or otherwise, attempts to interfere with the committee during their adjudications will be excluded from competition, and if the premium in any way has, in the opinion of the Board of Directors, been obtained by fraud, such premium shall be withheld.

6. On occasion, disputes arise over awards of premiums by judges for exhibits in various departments. Where disputes over premiums occur, protests must be made in writing, signed, sworn to and notarized by the party or parties making the protest and filed with the Board Secretary by noon of the day following the award, accompanied by a protest fee of $25. 00 (cash or certified check), which will be returned by the Mercer County Agricultural Society if protest is sustained. A review committee shall hear protests with the superintendent of the department involved. All protests will be considered at a time set by the Fair Board and all parties interested will be notified of the results. The Review Committee shall consist of the Superintendent of the department involved and two board members to be named by the Chairman of the Board. All decisions of the Review Board are final and without appeal.

7. It is mutually understood and agreed that in the event of fire, windstorm, disaster, act of God, act of war or public authority, riot, accident, strikes, scarcity of energy or fuel or any act beyond the control of power of either party preventing the holding of the Mercer County Fair in full or part, neither party shall hold the other liable.

8. If any disrespect is shown to the award or to the awarding judge by an exhibitor or his agent, he shall forfeit all awards made to him, and it shall be the duty of the member in charge to report the same to the Board at its first subsequent meeting.

9. There shall be elected or appointed by the President, an executive committee, consisting of the President, Vice President, Secretary and Treasurer. Secretary shall be a board member for voting purposes. Said committee shall have full control of the business of the board to let all contracts and inspect and approve all bills.

10. Anyone removing entry before release time, unless otherwise stated in Department, shall forfeit the right to show the following year.

11. The Board of Directors are empowered to adopt, from time to time, rules and regulations which, in their opinion, they deemed necessary to govern the affairs of the society.

12. Nothing in this Constitution or By-Laws shall in any way supercede the laws of the State of Ohio or the rules of the Ohio Department of Agriculture pertaining to the operation of county agriculture societies.
